｢지방공기업법｣ 제78조(경영평가 및 지도) ① 행정안전부장관은 제3조에 따른 지방공기업의 경영 기본원칙을 고려하여 대통령령으로 정하는 바에 따라 지방공기업에 대한 경영평가를 하고, 그 결과에 따라 필요한 조치를 하여야 한다. 다만, 행정안전부장관이 필요하다고 인정하는 경우에는 지방자치단체의 장으로 하여금 경영평가를 하게 할 수 있다.
